These Conditions of Use form an agreement between you and Malta Gift Service, and apply to all transactions carried out through this website. Please read this Agreement carefully before you place your order.

The “Goods” we are providing under this contract consist of the products available on this website.

Placing an Order

Ordering online is easy. Simply place the items you require in your shopping cart by clicking on the “Add to Cart” button whenever you see an item you wish to buy. Adding an item to your cart does not commit you to buy it as you can always remove it later. The contents of your cart and their total cost (shipping charges excluded) are listed in the “Shopping Cart” box in the right column of the screen. You may view a more detailed listing of your cart contents by clicking on VIEW BASKET. Once you have added all the items you need to your cart, select the correct Shipping Option and ‘Proceed to Checkout’

If you are not yet signed in when you click “Checkout”, you will be asked to confirm your e-mail Address and Password (if previously registered) or to create an account by providing an email address. A password will be sent to the email address provided. Once signed in, you will proceed to provide the billing address and the delivery address, if this is different to the Billing Address.

“Delivery” means we will deliver your order to any address in Malta and Gozo within 1-5 business days or on the date of your choice (the service includes gift wrapping and a complementary card with a greeting of your choice); “Pick-Up” is mainly for customers living in Malta who wish to pick up their order. Pick Up Location is an address in St. Paul’s Bay which will be communicated directly to the client. Once the Order is confirmed, it is submitted for payment via Stripe.

Please note that any goods purchased on this web site must be for personal use only and must not under any circumstances be purchased for commercial purposes or distributed commercially.

Acceptance of Orders

All orders are subject to acceptance by us. We will make sure of the following:

  1. That the products ordered are available for delivery within the stipulated time.
  2. That the price has not increased between time of order and our acceptance of it.

If either of these two conditions does not hold we will contact you to inform you of this. You will then need to confirm to us whether you wish to proceed with your order. If you decide to cancel the order your charge will be reversed so that you will receive a full refund. We will request the refund within one working day of your instructions to cancel the order.

Malta Gift Service will make every effort to ensure that the listed prices are correct and the items are in stock and available for delivery.

Prices, VAT and Currencies

Prices on this website include VAT (European Community Value Added Tax). The base currency used is EUR (euro). Since Stripe or your credit card company may use a different exchange rate to convert EUR back to your currency and/or possibly add a transaction fee, the actual amount charged to your account in your currency will most likely be a small percentage higher than the amount listed in the website.

Payment

Only payment via Stripe is acceptable at this time for orders made through this website. To reserve the goods and ensure product availability, you will be charged for your goods when the order is registered. Full refunds will be made on demand before shipping.

Listing and Descriptions

Malta Gift Service makes every effort to ensure that the product descriptions and photographs provided on this web site are accurate. Whilst the reproduction of colours and styles contained on the photographs shown on this website are as accurate as image, photographic processing and screen display will allow, Malta Gift Service cannot accept responsibility for slight variances in colour or style.

Clerical Errors

Malta Gift Service uses all reasonable endeavours to ensure that all information on this web site is accurate. In the unlikely event that an incorrect price or other information is displayed in relation to any product or service on this site due to a clerical, typographical, pricing or other inadvertent error, Malta Gift Service shall have the right to refuse to accept any order or cancel any contract to supply such product whether or not the order has been confirmed and the payment has been charged. In the event that your payment has already been charged for the purchase and the order is cancelled for this reason, Malta Gift Service shall issue a full credit to the value of the total amount charged for the order within 5 days.

Delivery Information and Costs

Malta Gift Service offers a fast and efficient delivery service to any address in the Malta and Gozo. We will deliver all goods within 2-5 business days from acceptance of the order. If you supply us with a preferred delivery date we will do our best to deliver on that date.

Package and delivery costs are 8.00 euro per order.

Checking the Status of Your Order

You will be able to check your order status at anytime by logging in to your account. You can also send an email with any queries you might have regarding order delivery.

Faulty Goods

In the unlikely event that any item is found to be faulty in any way, Malta Gift Service will offer a full refund or an exchange if replacement stock is available at that time, but will have no further liability to you.

Cancellation, Returns and Exchange Procedure

If you wish to cancel an order, or return or exchange any item purchased from this website you should contact us by email, mgss@maltagiftservice.com, giving us full details of your order and reason for return. This will ensure we have all the details on the order and item in question. In the email please let us know whether the item is faulty and, if you wish to exchange the item, give us a description of the replacement item.

We will handle each case accordingly and provide instructions for return of goods and pick up of any replacement item, if applicable. If the original item was faulty or supplied in error, we will deliver and/or exchange the item ourselves.

In case of cancellations prior to delivery, Malta Gift Service shall issue a full credit to the value of the total amount charged for the goods cancelled, including any delivery charges, to your Card Account account within 5 days of your cancellation notice. In case of returns, Malta Gift Service shall issue a full credit to the value of the goods cancelled, excluding delivery charges, to your Credit Card account within 5 days after return of goods. In case of exchanges, if the new item costs more than the returned item, the difference will be charged to your Credit Card account, or the customer may pay the amount in cash on pick-up. If the new item costs less than the original item, the difference will be refunded to the original Credit Card account within 5 days of the exchange.

The language in which contracts may be concluded shall be English.

These Conditions of Use and any contracts made under them are governed by and shall be governed and construed in accordance with the laws of Malta whose courts shall be courts of exclusive competent jurisdiction. We make no representation that materials on this Site are appropriate or available for use in other locations, and accessing them from territories where their contents are illegal is prohibited. Customers who access this web site from locations outside Malta are responsible for compliance with local laws, to the extent that any local laws are applicable. Nothing in these Terms shall in any way be deemed to restrict or affect your statutory rights under Maltese law.
